1. Acceptance of Terms

By accessing or using Picks.ch (“the Platform”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform.

These terms apply to all users of the Platform, including buyers, sellers, and visitors. We may update these terms from time to time, and your continued use of the Platform constitutes acceptance of the updated terms.

2. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3. Listings and Content

When creating listings on Picks.ch, you agree that:

• All information in your listings is accurate and not misleading
• You have the legal right to sell the items or offer the services listed
• Your listings comply with all applicable Swiss laws and regulations
• You will not post prohibited content including counterfeit goods, illegal items, or fraudulent listings
• Images used in listings are your own or you have the right to use them

We reserve the right to remove any listing that violates these terms or that we consider inappropriate for the Platform.

4. Payments and Fees

Picks.ch offers various paid services including featured listings, listing plans, and coin packages. All prices are displayed in Swiss Francs (CHF) and include Swiss VAT at the applicable rate (currently 8.1%).

Payments are processed securely through our third-party payment provider (Stripe). By making a payment, you agree to the payment processor's terms of service.

Refunds are handled on a case-by-case basis. Contact our support team for refund requests.

5. Transactions Between Users

Picks.ch acts as a platform connecting buyers and sellers. We are not a party to any transaction between users. We do not guarantee the quality, safety, or legality of items listed, the accuracy of listings, or the ability of sellers to sell or buyers to pay.

Users are responsible for conducting their own due diligence before completing any transaction.

6. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose or in violation of Swiss law
• Post false, misleading, or fraudulent content
• Harass, abuse, or threaten other users
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Scrape, mine, or extract data from the Platform without written consent
• Use automated tools or bots to interact with the Platform

7. Intellectual Property

The Picks.ch name, logo, design, and all associated content are the intellectual property of Picks.ch. You may not use, reproduce, or distribute our intellectual property without prior written consent. Content you create and post on the Platform remains yours, but you grant Picks.ch a non-exclusive license to display and distribute it within the Platform.

8. Limitation of Liability

Picks.ch is provided “as is” without warranties of any kind. To the fullest extent permitted by Swiss law, Picks.ch shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

9. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
